South Korea Plans November Rules for Its 22% Crypto Tax in 2027

South Korea's National Tax Service will issue detailed standards for taxing digital assets around November, its commissioner told a National Assembly finance committee audit on Tuesday. The notice is meant to settle how staking, airdrops, hard forks and decentralized finance are treated under a regime that starts on 1 January 2027. The rate is 20% national income tax plus a 2% local surcharge, 22% together, charged on annual gains above a basic deduction of 2.5 million won once acquisition costs and transaction expenses come off. The first returns fall due in May 2028. The agency gave no estimate of how many people will owe anything.

Transfer or loan is the test

The commissioner put the question in terms of substance. Four of the outlets in this sweep render his name Lim Gwang-hyeon and the two Korean-language ones write Lim Kwang-hyun. They are the same person.

"What matters is the economic relationship rather than transaction types or names," Lim said, in Digital Today's account of the audit.

Bloomingbit translates the same remark as taxability turning on economic substance over the name of a transaction. The sense agrees; the wording does not. On that test, Lim said airdrops and hard forks are taxable where they carry the nature of a transfer or a loan. Staking was not settled and needs further consultation with the finance ministry, whose English name the outlets themselves write two ways. Decentralized finance was named as unresolved by every outlet checked.

The rule reaches back before the start date

Gains and losses are netted across the year before the deduction applies, and the levy is charged as separately taxed other income under the Income Tax Act. For coins bought before the regime begins, the acquisition value is generally the higher of the original cost or the market value immediately before implementation, which spares holders tax on paper gains that predate the law. Three outlets state that rule in the same terms; a fourth says only that special rules may apply. BeInCrypto alone converts the 2.5 million won deduction, at about $1,870.

Thresholds of that shape are becoming common. Greece has drafted its first crypto tax at 10% with a EUR 500 exemption.

Five exchanges, and the data nobody has

Working-level talks on reporting systems are under way with the five domestic won-market exchanges: Upbit, Bithumb, Coinone, DigitalX and Gopax. "We are continuously consulting with exchanges at the working level," Lim said, in reply to questioning at the audit over whether their records will be consistent enough in time. Bloomingbit, and no other outlet here, describes a system being built to compare exchange data automatically against filings on Hometax, the agency's online tax portal.

The harder gap is everything outside those five. Lim acknowledged the agency cannot readily obtain data on trades at overseas venues or on transfers between private wallets, and said the OECD's Crypto-Asset Reporting Framework would improve exchange of information between tax authorities without capturing every transaction. Regulators had the websites of 27 unregistered overseas exchanges blocked this week, which narrows access to offshore venues without telling the tax office what was traded on them before.

Nothing is notified yet

November is a plan, not a publication date. The month is on the record from Tuesday's audit and the exact day is not, and one outlet notes that the year was never stated outright in the remarks themselves. COINOTAG dates a follow-up report on the notification plan to a comprehensive audit on 22 October; Digital Today carries the same request with no date on it.

The start date is the other open end. Proposals to postpone the regime again sit before the National Assembly, and Bloomingbit reports the commissioner saying the agency will follow whatever the legislature decides; the framework was first approved in 2020 and the start date has already moved more than once. The agency's own clock runs past both. Lim said the service must receive data and begin verification from the tax returns filed in May 2028, which puts the first real test eighteen months after the standards appear.
